Comprehensive Trademark Registration Procedure in Singapore

1. Preliminary Search
   – Initiate a search to verify that your intended trademark is not already registered. This step can help avoid potential complications and save both time and resources in the long run.

2. Submitting the Application
   – Complete the application by submitting Form TM 4 either online via the IPOS Digital Hub or through a paper submission. The application must include:
        ◦ The applicant’s name and contact details
        ◦ A clear graphic representation of the trademark
        ◦ A categorized list of the goods/services
        ◦ A declaration confirming the intent to use the trademark

3.IPOS Examination
   – Following submission, the Intellectual Property Office of Singapore (IPOS) will review your application to ensure it meets legal requirements, particularly focusing on the distinctiveness of the trademark.

4. Publication in the Trade Marks Journal
   – Upon approval, the application will be published in the Trade Marks Journal for a period of two months. This allows third parties to raise any objections they may have regarding your trademark.

5. Final Registration
   – If no oppositions are received, or if any raised oppositions are resolved favorably, IPOS will grant a certificate of registration for your trademark.

6. Trademark Renewal
   – Protection for a trademark is valid for 10 years and can be renewed indefinitely. To maintain protection, a renewal application must be filed before the expiration date.

Common Pitfalls in Trademark Registration

  • Neglecting to perform a comprehensive preliminary search.
  • Failing to provide a detailed description of the goods/services involved.
  • Missing crucial deadlines during the examination process.
  • Underestimating the necessity of prompt responses to any oppositions.

International Trademark Registration

Companies can pursue international trademark registration through the Madrid Protocol, which enables the submission of a single application covering multiple countries. This approach simplifies the process but requires compliance with each jurisdiction’s regulations.
